Walter D. Willson and Gregg A. Caraway, of Wells, Marble & Hurst, PLLC, successfully defended an accidental death insurer in a suit filed in the United States District Court for the Eastern District of Michigan. In that case, the plaintiff claimed that his mother was killed in a common carrier accident while in the country of Yemen, thus entitling him to $900,000 in insurance proceeds. The Court granted the insurer’s motion for summary judgment, finding that the policy was not ambiguous and that the plaintiff’ had failed to adequately prove his common carrier claim.
