On January 21, 2010, Walter D. Willson received a favorable ruling on behalf of his clients, two national corporations, when a Delaware court granted the Defendants’ Motion for Judgment on the Pleadings. The Court refused to convert the motion to a motion for summary judgment and ultimately found that the Defendants were entitled to relief because Plaintiffs’ allegations that Defendants had issued, procured or underwritten a policy on behalf of Plaintiffs were baseless despite documents apparently generated by Plaintiffs’ mortgage lender that appeared to suggest Defendants’ involvement with the underlying insurance coverage.
