Richard G. Norris, II, obtained summary judgement for his client, One Life America, Inc., in an action by the Plaintiff alleging the denial of a promotion and termination of employment due to an ongoing battle with breast cancer. The Plaintiff asserted claims under the Americans With Disabilities Act, Family Medical Leave Act, and Employee Retirement Income Security Act. The U.S. District Court Southern District granted One Life’s motion for summary judgment holding that there was no evidence which established a causal link between Plaintiff’s cancer, the denied promotion or ultimate termination, nor was there any evidence to rebut One Life’s legitimate, non-discriminatory reasons for refusing to promote Plaintiff and, ultimately, terminating her.
