Kenna L. Mansfield, Jr., recently obtained summary judgment on behalf of an insurer in an ERISA claims case seeking disability benefits. At issue was a determination by the insurer to offset benefits by an estimated amount of social security benefits due to a failure to apply for SSDI, as well as a subsequent determination to terminate benefits. The court granted summary judgment on both determinations.
