On May 18, 2017, Kelly D. Simpkins and Kevin A. Rogers obtained a directed verdict in an alleged bad faith failure to pay property damage claims. The Plaintiff sustained damage to his home as a result of a windstorm. The insurer paid all covered losses but Plaintiff claimed he was entitled to the face value of his policy and a new home. The Plaintiff asserted claims for breach of contract and tortious breach of contract, seeking compensatory and punitive damages. Kelly represented the insurer at trial Upon motion, the Court directed a verdict in favor of the insurer.
