  • Granted summary judgment on behalf of insurance carrier in two cases involving insurance coverage dispute under a professional malpractice policy, where the underlying claims sought in excess of $3,000,000 in damages, with Court holding that carrier was entitled to rescind policy for material misrepresentation, that coverage was otherwise excluded under policy, and dismissed claims for bad faith, which was subsequently upheld on appeal to the United States Court of Appeals for the Fifth Circuit – Imperium Ins.
